TERMS & CONDITIONS OF TRADING

Supervision - Workmates Australia supplies its employees to work under the supervision and direction of the client company’s designated supervisors. Standard of workmanship and timely completion of work are the responsibility of the client.

Client Obligations – the client acknowledges that we are not performing the services required of our employees or independent contractors: but are instead the supplier of our employees and independent contractors, at the client’s request, to perform the work that is has requested. From the time that our employees or independent contractors report to the client for their duties they are under the care, control and supervision of the client for the duration of the assignment.

In these circumstances, the client agrees we will not be liable to the client in respect of any damage, loss or injury of whatsoever nature or kind, however caused, whether by our negligence or the negligence of one of our workers, their servants or agents or otherwise, which may be suffered or incurred, whether directly or indirectly, in respect of the services provided under these conditions of assignment.

Purchase Order Number – clients must provide this information when an order is placed.

Confirmation of working hours – Workmates Australia requires client companies to notify and confirm our employees’ individual working hours by 10 am Monday. Time sheets are faxed to clients every Friday. The client company’s time sheets may be used.

Invoicing and Payment – Workmates Australia runs a Monday to Sunday payroll and invoicing system. All hours worked up to midnight Sunday for the preceding 7 days will be invoiced on the next day. Payment terms are strictly seven (7) from date of invoice.

Minimum Hire Period – in general there is a minimum hire period of four (4) hours per day, but some awards and work environments dictate a longer period. The client company is responsible for confirming the minimum hire period with Workmates Australia at the time labour is ordered for hire.

Permanent Placement Fees – if a client company seeks to engage a Workmates Australia employee as a permanent company employee, a placement fee will be charged of 10% of annual salary. If the Workmates Australia employee has been engaged continuously for more than six months by the client company no permanent placement fee will apply. Should a client company engage a Workmates Australia employee without consulting Workmates Australia, the normal permanent place fee applies – 10% of the employee’s annual salary. Should a client company having engaged Workmates Australia to fill a permanent position, then cancel the order you are liable to pay a service fee of not less than 50% of the original fee depending on work done by Workmates Australia.

Special Site or Over Award Rates of Pay – the client company is responsible for ensuring that Workmates Australia is provided with all relevant information on award rates of pay, over award payments, site agreement rates and allowances, in order that Workmates Australia can pay compatibly with client company employees.

Site Conditions – the client is responsible for providing safe working conditions for Workmates Australia employees at all times.
